TERMS AND CONDITIONS OF SERVICE

These General Conditions of Purchase regulate the use of the website castaner.com (hereinafter "The Web") Distribuciones Calzado Banyoles, s.l., hereinafter Castañer, a commercial entity incorporated under the Spanish constitution, with registered office at c/ Menuts, 28 17820 Banyoles (Girona), registered in the Commercial Register of Girona, volume 1269, folio 173, sheet 21554, entry 2, with CIF B50667823.

The use of the services of the online store presupposes, the adhesion to the General Conditions of Purchase in the version published at the time of the purchase order. It is therefore advisable that you read these General Conditions of Purchase before making a purchase.

 

ACCESS TO THE WEB

To make a purchase through the web, you must be over 18 years old and have legal capacity to contract the products offered on the web. For this reason, Castañer reserves the option to request at any time, documentation proving your age. In case we verify that you do not have the required age or do not attend the requirement of Castañer, or do not attend it correctly, Castañer will prevent you from contracting the requested product.

You do not need to be registered to access and browse the site. However, you can register and obtain exclusive advantages such as, for example, speeding up the process in subsequent purchases, for which you will only need to provide your e-mail address and password.

The registration process is considered a formalization of a legally binding contract between Castañer and the user, in accordance with the terms of this Legal Notice and the registration conditions included in it. As a registered user you acknowledge that you have read and understood the terms and conditions of this Legal Notice and the registration conditions included in it, and that you agree to comply with all its provisions. You also acknowledge that you have read and accepted the Privacy Policy.

 

PRICE AND METHOD OF PAYMENT

The price of the products will be the one shown in euros on the website and will include vat and any other tax or fee applicable in the territory of application, as well as any shipping costs duly itemized in accordance with the provisions of the 'shipping and expenses policy'.

Castañer may offer discounts as part of certain promotions, although such discounts may not be combined with other promotions.

Castañer reserves the right to make any changes it deems appropriate on the prices of products. In any case, the price we apply to the purchase order placed will be the one that appears at the time you accept the general conditions of contracting the selected product.

 You will be able to make a single payment through one of the following methods:

  • Debit or credit card (Visa Electron, Visa, Mastercard, American Express, Maestro or others provided on the website)
  • Paypal
  • Klarna

*In order to offer you Klarna's payment methods, you may need to enter your personal contact details and order details in the form on the payment tab, so that Klarna can evaluate and qualify the payment method used. Your personal data submitted through Klarna's form will be processed on the basis of its own privacy policy.

You must include the payment information required in the purchase procedure. The charge will be made once it is accepted by the financial institution or platform through which the payment is made, otherwise the purchase will not be completed.

Subsequently, you will receive an e-mail confirming the purchase of the product and a copy of these general terms and conditions. 

 

PROMOCIONIES

  "Natura Bissé x Castañer" is subject to the following terms and conditions:

  • The promotion is effective as of May 22 and will remain in effect until available stock is depleted. The end date will be subject to the availability of promotional gifts.
  • The promotion is exclusively aimed at purchases made in Europe through the castaner.com website and in Castañer's own stores (Castañer Coello, Castañer Sevilla, Castañer Barcelona, Castañer Palma de Mallorca, Castañer Llafranc, Castañer Cadaqués, Castañer Paris and Castañer Milan).
  • To be eligible to receive the promotional gift, the total value of the purchase must be equal to or greater than 400€. The gift consists of a cosmetic bag with 4 samples of Natura Bissé creams, valued at €80.
  • The number of promotional gifts is limited and will be awarded on a first-come, first-served basis while supplies last. 
  • Promotional gifts are not transferable or redeemable for cash or other products.
  • This promotion cannot be combined with other current offers or promotions.
  • The Provider reserves the right to unilaterally modify these Conditions, without affecting the promotion for which the sample was purchased prior to the modification. In any case, these general conditions must be consulted before purchasing the products.

 

DELIVERY OF PRODUCTS

  • Delivery time

If the delivery of your product is in Spain, you will receive them within approximately one (1) to two (2) working days from the date of shipment, deliveries will be made throughout the day, without time preference. For the rest of the European countries, the approximate delivery time will be from two (2) to four (4) working days. 

Castañer may extend delivery times in periods of sales and high season or when an irregularity is detected in the order. The delivery time will never exceed thirty (30) days from the date of order confirmation.

No deliveries will be made on Saturdays, Sundays and holidays and will be made on the next business day.

The order of the product shall be binding when the customer confirms it in the purchase procedure.

  • Home delivery

Deliveries will be made to the place you have indicated in the purchase procedure as long as it is within Spain (except the Canary Islands, Ceuta and Melilla) and also in the following countries: Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Sweden and Slovakia.

The order of the product shall be binding when the customer confirms it in the purchase procedure.

  • Delivery incidents  

We will deliver your products to the address you have indicated in the purchase procedure. If an error in the address is detected, the customer service department will contact you as soon as possible.

Shipping addresses must be physical locations accessible to courier companies. We cannot ship to pick-up points or post offices.

If at the time of delivery of the products there was no one at your home, the courier company will make up to three (3) attempts. If your shipment is not delivered after these attempts, your order will be returned to Castañer and you will need to contact the customer service department to arrange delivery.

In case you want to change the delivery address after purchasing the product, please contact the customer service department through this form form indicating the order number and the correct shipping address.

At the time of delivery, you must confirm receipt of your order to the courier company.

  • Information about shipping costs

All orders placed on castaner.com and shipped within the European Union are free of charge. Rates are subject to change according to specific promotions. You accept the rate in the order form.

In case the shipment has customs charges, these will be paid by Castañer, you should not pay any amount in customs concept.

Castañer reserves the right to modify these amounts and conditions.

 

AVAILABILITY

All product purchase orders are subject to product availability. In case of unavailability of the contracted product, Castañer will inform you of this and may offer you a product of similar characteristics of equal or higher quality, although you can cancel the purchase request and recover the amount paid as soon as possible.

All other terms and conditions set forth in the 'shipping and handling policy' shall also apply.

 

WITHDRAWAL AND RETURNS

To return a product, please follow the procedure provided for in the return policy.

You have a period of 30 calendar days from the date of receipt of the product to exercise your right of return or withdrawal. We clarify these concepts:

A.Return: in case of tare or defect.

B.Withdrawal: by customer's decision

To manage the returns and cancellations of products quickly and easily to Castañer, you have at your disposal the collection system of CorreosExpress in the case of domestic shipments (Spain). For shipments from countries outside Spain, a label is available to manage the return with DHLExpress. You will find detailed information by clicking HERE.

Lefunds are free of charge

Castañer will accept returns if the product is in perfect condition and has not been used. For its return you must use the original box or packaging or similar and that it has not been damaged.

To make a return, please fill out the form that you will find inside your order and send it to Castañer together with the product to be returned, with its box and its internal packaging or similar. We cannot accept returns without documentation.

Upon return, we will always refund the amount paid on the day the purchase was made, in the same payment method used. Once we receive the item to be returned, we will proceed to its validation and reimbursement within 7 working days. The deadline for the economic refund to be effective will depend on the destination bank. We recommend that you contact your bank for more information.

We do not make exchanges as such, so you will have to make the return and place another order with the new product. The rates of the items may vary in periods of sales or promotions. If you want to make an exchange, the amount to pay for the new purchase will be the current rate on the day of the new order.

WARRANTY OF PURCHASED PRODUCTS

The warranty offered by Castañer is the one established in the Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Protection of Consumers and Users. Therefore, any Castañer product has a warranty period of three years from the date of purchase.

If you are not satisfied with the product sold by Castañer, you must inform us as soon as possible and request the replacement of the product. In order to be able to request your right to warranty, it is essential to have the proof of purchase. We will also need photographs where the defect is evident.

This warranty does not apply to products whose defect results from natural wear and tear or misuse.

We will repair or replace your product, provided that the hygienic conditions are optimal. If neither of the two cases is possible, we will refund the amount, in the same form of payment in which the purchase was paid.

In case of return due to non-conformity, the return costs will be borne by Castañer.

Please follow the instructions of the customer service department at all times to exercise your warranty rights.

 

RESPONSIBILITY

Castañer makes every effort to provide you with accurate and complete product information that is as up to date as possible. Even so, the color of the products that appear on the website may vary depending on the characteristics of the customer's devices. For this reason, Castañer reserves the right to rectify the images of the products when necessary.

Castañer will not be responsible for any errors that may occur in the delivery of the products in the event that you have not correctly completed the purchase form provided on the web. If there is any incident in the delivery of the products, Castañer will inform the customer as soon as it becomes aware of it.

The risk of the products will be transferred to the customer from the time they have been made available to them and, in the case of their return, they will continue to be at your expense until the delivery of these to Castañer.

 

SOCIAL NETWORKS

Castañer has profiles on social networks (Facebook, Youtube and Instagram), with the purpose of informing about its products and updates about the company.

If you join any of the profiles opened by Castañer in social networks you must respect and comply with the terms and conditions of that social network.

Castañer can perform the following actions:

  • Access the public information of the user profile.
  • Send individual messages through social network channels when allowed.
  • update the profile status to be displayed on the user's profile.

We may conduct contests, promotions and sweepstakes through our social networks.

 

ADVERTISING

Castañer may include on the web advertising content or sponsorship of third parties. Advertisers and sponsors are solely responsible for ensuring that the material submitted for inclusion on the web fully complies with the law.

Castañer shall not be liable for any error, inaccuracy and/or irregularity that may be included in the advertising content or that of the sponsors, nor for non-compliance with current regulations.

 

LINK POLICY 

  • Links to the web

Those third parties who intend to include in a website ("linking site") a link that directs to the web, or a framing with the same, must necessarily obtain the prior written consent of Castañer.

The authorization granted by Castañer does not mean that it endorses, promotes, guarantees and/or recommends the content or services of the linking site or that it is responsible for its content.

The linking site must comply with current legislation and may not, under any circumstances, host its own or third party content that is unlawful and/or harmful (violent, racist, denigrating, etc.) and/or inappropriate or irrelevant in relation to the products and/or services of Castañer.

In the event of non-compliance with any of the terms referred to above, Castañer will immediately revoke the consent granted to the linking site, which must remove the link.

  • Links to other websites

The website may include various links that allow the user to access other websites ("linked sites").

In no case, the existence of linked sites implies recommendation, promotion, identification and/or conformity of Castañer with the manifestations, contents and/or services provided through the linked sites.

Castañer is not responsible for the content, conditions of use, privacy policies, and other conditions of the linked sites, being the user the only responsible for checking and accepting them each time you access and use them.

 

COMPLAINTS AND CLAIMS

You can contact us through the means indicated in "legal notice" LINK, to express your complaints and claims, where you will also find a complaint form to address them as soon as possible and within a maximum period of one month after they are submitted.

You have the right to claim the invoice of your purchase in physical support of any order you place.

 

NULLITY

If any of the clauses of the general contracting conditions are declared, totally or partially, null or ineffective, such nullity or ineffectiveness shall only affect such provision or the part thereof that is null or ineffective, and the same shall remain in force in all other respects, and such provision or the part thereof that is affected shall be deemed not to be in force. the general terms and conditions shall cease to be valid only with respect to the invalid or ineffective provision, and no other part or provision hereof shall be annulled, invalidated, impaired or affected by such invalidity or ineffectiveness.

 

LANGUAGE

The general terms and conditions are written in Catalan, Spanish, French, Italian and English. In case of contradiction between these versions, the Spanish version shall prevail.  

 

APPLICABLE LAW AND JURISDICTION

The general terms and conditions shall be governed by and construed in accordance with Spanish law.

Likewise, in the event that any conflict or discrepancy arises in the interpretation and/or application of the general contracting conditions, the competent courts shall be those provided for in the applicable regulations regarding jurisdiction over consumers and users.
